PCCo. Returns Policy

• Returns will be process after the warehouse has inspected items and declares the items are in their original condition. Please allow 7 business days from when it is received by our warehouse for your return to be processed.
• “Clearance” or “Final Sale” items cannot be returned or exchanged.
• You must obtain a Return Authorization (RA) number and return address by email request (Email: returns@phlipseyed.com). Returns or exchanges will not be processed without an RA number.
• All returns must have a return label on the package with an RA number.
• Once an RA is processed, the items must be shipped out immediately. Domestic packages need to be received within 2 weeks of the date the RA was created. International packages need to be received within 3 weeks of the date the RA was created.
• You may return an item within the first 14 days after receipt so long as the items are in the original condition for a full refund, this excludes bargain items.
• You may exchange an item within 30 days of receipt for another item or store credit.
• Items bought at 40% off or over are eligible ONLY for exchanges, unless noted in the product description.
• No refunds are available for sale items – only exchange or store credit
• Products must be in the condition you received them and in the original box and/or packaging.
• Items worn, washed or with stains cannot be returned. If you do ship such items, PCCo. will not be responsible for processing and/or returning such items.
• Shipping & handling is not refundable for returns.
• There will be a $5 processing fee for items returned without either the original receipt or an RA number.
• We recommend customers receive a tracking number when sending back returns.

Welcome to the Phlipseyed Clothing Co. website (the “Site”). The Site is provided as a service to our customers. Please review the following terms and conditions of use, which govern your use of the Site (the “Agreement”).

Your use of the Site constitutes your agreement to follow and be bound by the Agreement. We reserve the right to update or modify this Agreement at any time without prior notice. For this reason, we encourage you to review the Agreement whenever you use the Site. If you do not agree to these terms, please do not use the Site.

Right to Change Site

We reserve the right to modify, suspend or discontinue the Site or any service, content, feature or product offered through the Site, with or without notice, at any time and in our sole discretion.  You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Site, or any service, content, feature or product offered through the Site.

Site Content

Unless otherwise noted, the Site, and all materials on the Site, including text, images, illustrations, designs, icons, photographs, video clips and other materials, and the copyrights, trademarks, trade dress and/or other intellectual property in such materials (collectively, the “Content”), are owned, controlled, lawfully used, or licensed by Phlipseyed Clothing Co.  In addition, the trademarks for third party products available on the Site are owned by third parties and lawfully used by Phlipseyed Clothing Co.

The Site and the Content are intended solely for personal, non-commercial use. No right, title or interest in any downloaded Content is transferred to you as a result of any downloading or copying from the Site. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or exploit in any way any of the Content or the Site.

User Comments, Feedback, and Other Submissions

If you send certain specific submissions or you post comments or send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, “Comments”), you agree that Phlipseyed Clothing Co. may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any Comments that you forward to Phlipseyed Clothing Co.  Phlipseyed Clothing Co. is and shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay compensation for any Comments; or (3) to respond to any Comments. Phlipseyed Clothing Co. has the right but not the obligation to monitor and edit or remove any Comments.

You agree that your Comments will not violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary right. You further agree that your Comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Site. You are solely responsible for any Comments you make and their accuracy. Phlipseyed Clothing Co. takes no responsibility and assumes no liability for any Comments posted by your or any third party.  You agree to indemnify Phlipseyed Clothing Co. for any third party claims against Phlipseyed Clothing Co. relating to or arising out of your Comments.

Personal Information Submitted Through the Sites

Your submission of personal information through the Sites is governed by our privacy policy, which can be reached by clicking on the “Privacy Policy” link located in the sidebar section of the Site (the “Privacy Policy”). This Agreement incorporates by reference the terms and conditions of the Privacy Policy.

Copyright Complaints

Phlipseyed Clothing Co. respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact Phlipseyed Clothing Co.’s copyright agent and provide the information specified below:

• An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
• A description of the copyrighted work that you claim has been infringed upon;
• A description where the material that you claim is infringing is located on the site;
• Your address, telephone number, and e-mail address;

Errors, Inaccuracies, and Omissions

Occasionally there may be information on our Site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice (including after you have submitted your order).

Indemnification

Choice of Law

This Agreement shall be construed in accordance with the laws of the State of Arizona, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and/or federal courts of the State of Arizona.

Force and Effect of Agreement

The waiver of any provision of the Agreement shall not be considered a waiver of any other provision or of Phlipseyed Clothing Co.’s right to require strict observance of each of the terms herein. If any provision of the Agreement is found to be unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full force and effect.

Information Collection & Use

Orders

If you purchase a product from us, we request certain personally identifiable information from you on our order form. You must provide contact information (such as name, email, and shipping address) and financial information (such as credit card number, expiration date).

We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.

We do not store your credit card information. There is also the option to receive our Email Newsletter updates. If you choose to receive these you should expect  HTML newsletter content to arrive at the email address you provided with your purchase.

Phlipseyed Clothing Co. is the sole owner of the information collected on phlipseyed.com.

Surveys or Contests

Phlipseyed Clothing Co. often provides you the opportunity to participate in contests or surveys on our site. If you participate, we will request certain personally identifiable information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and shipping address), and demographic information (such as zip code).

We use this information to notify contest winners and award prizes and to send participants our HTML email newsletter.

We sometimes run contests in conjunction with other websites or services. When we do so, any information you provide as a result of entering the contest or survey may also be provided to the affiliate but such practices will always be clearly marked at the point of entry.

We use the information we collect from you for billing purposes and to fill your orders. We do not store your credit card information.

Supplementation of Information

In order to process your Credit Card orders, we use Paypal, a third party service, to validate & verify your account information. All billing and account info is transmitted via https which is a secure encrypted protocol system.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our Web site. You cannot opt out of disclosure of your personal information if required by lawful order.

Log Files

We do not link this automatically-collected data to personally identifiable information. We use two third-party tracking services; Webtrends & Clicktracks that use cookies to track non-personally identifiable information about visitors.
